Terms and Conditions of Sale
Following the amendment introduced by Legislative Decree 21/2014 (in force since 13 June 2014), it is considered that, as far as consumer protection in online sales is specifically concerned, the relevant regulations are essentially contained within the so-called ‘Consumer Code’ (Legislative Decree 206/2005) and, more specifically, in the provisions governing distance selling.
General provisions
La Goccia d’Oro s.c.a. (VAT number and tax code 00145420840, REA registration number AG-104573), with its registered office in Menfi (AG) at Contrada Feudotto snc, hereby informs you that relations between consumers and the company are governed by the following terms and conditions. The term ‘consumer’ refers to any natural person acting for purposes unrelated to any commercial, business or professional activity. Before placing a purchase order, the consumer is required to read these terms and conditions of purchase and to familiarise themselves with all the product details, including prices, as set out in each product description on the website www.shop.lagocciadoro.com.
By submitting a purchase order, the consumer unconditionally accepts these terms and conditions of sale and therefore undertakes to comply with all such terms and conditions in their dealings with La Goccia d’Oro s.c.a., including those relating to payment methods.
The purchase contract is concluded, following the correct completion of the online purchase order, when La Goccia d’Oro s.c.a. sends an email to the address provided by the consumer, confirming receipt of the order and summarising its details.
Any changes to the terms and conditions of sale will take effect from the moment they are published on the website www.shop.lagocciadoro.com and will apply to sales made from that point onwards.
Contract of Sale
The term ‘online’ sales contract means a distance contract, that is to say, a legal transaction concerning movable goods and/or services entered into between a consumer customer and the company La Goccia d’Oro s.c.a. as part of a distance selling system organised by La Goccia d’Oro s.c.a. itself, using a means of distance communication known as the ‘internet’.

Selling prices and payment methods
All sales prices shown in the online catalogue include VAT. The delivery charge is clearly indicated in the relevant section of the website, which the customer should check before confirming their purchase; in the case of delivery abroad, any additional costs arising from taxes or duties required under the legislation in force in the country of destination shall be borne by the consumer. The consumer may pay for the goods ordered using only the payment methods indicated ‘online’ at the time of purchase, which are:

La Goccia d’Oro s.c.a. will issue a tax invoice or equivalent tax document, which will be sent by email.
Cash on delivery is not available for orders from abroad.
Delivery and shipping options
La Goccia d’Oro s.c.a. will arrange delivery via a courier or a freight forwarder of its choice.
Delivery arrangements will be as follows: couriers may deliver between 9.00 am and 7.00 pm; if the recipient is absent at the time of delivery, a delivery notice will be left and the customer must personally contact the courier as soon as possible to arrange a delivery time. Delivery times, which will in no case exceed those set out in Article 54 of Legislative Decree No. 206/2005 (30 days from the date of order), may vary from the day the order is placed to a maximum of seven working days. The aforementioned delivery times apply to products in stock at the time of ordering. Delivery will be made by the carriers to the street level. However, the supplier shall not be held liable for any delay or failure to deliver attributable to force majeure or unforeseeable circumstances.
The supplier guarantees that the products listed in its online catalogue are available at the time of publication; should any items be out of stock, the supplier will contact the customer by telephone or email.
Warranties and support procedures
La Goccia d’Oro s.c.a. sells high-quality products; however, it accepts no liability for any inaccuracies in the product specifications or documentation. The main specifications are not binding and may be subject to change by the manufacturer without prior notice.
Consumer obligations
Consumers are strictly prohibited from entering false, and/or fabricated, and/or fictitious data during the registration process required to initiate the procedures for the performance of this contract and any related further communications; personal details and the email address must be exclusively the consumer’s own genuine personal data and must not belong to third parties or be fictitious. It is expressly forbidden to create duplicate registrations for a single person or to enter details belonging to third parties. Goccia d’Oro s.c.a. reserves the right to take legal action against any breach or abuse, in the interests of and for the protection of all consumers.
Consumer’s right of withdrawal
The customer has the right to withdraw from the purchase contract within the first ten days following delivery of the parcel, as provided for by Legislative Decree No. 50 of 15 January 1992 on ‘transactions outside business premises’. Any customer wishing to withdraw from the purchase must notify us in advance by registered letter with acknowledgement of receipt or by email. A fundamental condition for withdrawal is that the parcel must be intact, perfectly sealed and in its original packaging. The parcel must be returned in person or via express courier (always with insurance), exclusively to the address we will provide following notification of withdrawal. Furthermore, we reserve the right to inspect the condition of the returned item before processing the refund, which will cover only the cost of the product. Shipping, packaging and insurance costs will not be included in the refund.
Termination of the contract
The supplier is entitled to terminate the contract by giving notice to the consumer. In such a case, the consumer shall be entitled solely to a refund of any sum already paid. The obligations assumed by the consumer, as well as the guarantee of successful payment made by the consumer using the means referred to in Article 6, are of an essential nature; consequently, by express agreement, any breach by the consumer of even one of these obligations shall automatically result in the termination of the contract pursuant to Article 1456 of the Civil Code, without the need for a court order, without prejudice to the supplier’s right to bring legal proceedings to claim compensation for any damages.
Order cancellation and notifications
Consumers may request any information by contacting the company via the following email address: support@lagocciadoro.it. Should the consumer decide to cancel an order, they must send an email within 24 hours of the order confirmation date to support@lagocciadoro.it with the subject line: “cancellation of order no.”, stating the personal details already provided with the order.

Competent court
These general terms and conditions, and indeed any purchase made by the consumer on the website www.feudotto.it, are governed by Italian law. In the event of any dispute relating to the application, performance, interpretation or breach of these general terms and conditions, the court of the customer’s place of residence or elected domicile shall have exclusive jurisdiction, provided that such place is situated within the territory of Italy. Should the customer’s place of residence or elected domicile not be situated within the territory of Italy, the court of Rome shall have jurisdiction.
